PLEASE HELP!!!!

NY. I have a two and a half year old daughter. She has always lived with me and been in my care. Her father has been out of her life more then he has been in it. He has lived in Florida for the past year strait. He has called about 5 or 6 times that whole time. And seems only to care when confronted. He does pay child support, a small amount of $47.00 a week. I provide a very loving, stable and safe home and enviroment for my child. I want to get sole custody. But is it true that because her father doesn't reside in the same state that she and I live in, do I automaticly have sole custody. Also if I go to court, and say, that he is awarded at least visatations, is he allowed to take her out of state to see her- that can't be healthy to bounce a child back and forth in airplanes and long drives. That could really damage a child! Please give me some advice. PLEASE HELP!

If no custody orders are in place then you can file for sole custody. You do not automatically have that just because he is in FL. He can then petition for visitation and yes, he will be allowed to take the child out of state to his home in FL. I suggest you document everything and also petition for an increase in CS while you are at it.
