Can you sue someone in small claim court after they filed for bankrupcy? It is a personnel loan. They promised to pay me after they filed for bankrupt.

You can sue if the loan was not listed as an amount to be discharged on the BK petition.

My response: did you read my post? It would not matter if she promised to pay you back and signed in the blood of her first born child, if the debt is listed in the BK, because it is unsecured, it is dischargeable.

Double check with a bankruptcy attorney. I think if a debtor makes an agreement to pay back a debt that is being discharged in bankruptcy or has been discharged in bankruptcy, the debt is still owed.
