Someone I know stole my Refund

What is the name of your state (only U.S. law)? PA

I recently had my girlfriend to my taxes for me, and she ended up keeping the money for herself. She asked me did i want a check or direct deposit into her acct, I told her check or whatever(thought she would give me the money.) The taxes came in and she decided that she was going to keep it, she did not say anything prior to this to me until after the taxes came in. I have a typed letter from her stating that she was going to keep the money. I am wondering if I can do anything about this incident. I read on the internet that would be considered theft by deception through electronic transfer.

Anyway any help would be good. Thanks.

Since I see you are calling her your girlfriend, the police will probably tell you its a civil matter, but I suggest you report it to them first, then sue her in civil court for the money.

I failed to clarify that she is my ex. I am still used to calling her girlfriend.. we have been broken up so would this make any difference in the situation?

Yes. It will make it easier for you to pursue this criminally.

Go to the cops. Insist on a report, an investigation if possible, then when concluded that she in fact stole your tax refund, sue her civilly

Depends on the amount of refund.

Depends on what the DA wants to do criminally.

Depends on her defense.

Depends on the judges and the DA's recommendation. It could include jail, it could include restitution, it might be a felony, it might be a misdemeanor, might be a federal offense... No chrystal ball here, sorry.

Civilly, she will be ordered to pay you, in the form of a judgment.

the refund is 600 bucks i am guessing the state taxes(like 200 bucks) will goto her also. I think here anything over 500 dollars is considered a felony.

Well actually they can get you on a felony here for stealing gum out of a store.. so I dunno..

Keep with it, dont allow her to get away with it.

I suggest you make a police report, right now. since you have just discovered the theft. The letter you mentioned, show that to them. Keep it safe, its your best piece of evidence. I hope she signed it. Text her. Tell her, if she doesn't bring your money right now you are going to the cops. Get more in writing, absolutely from her... in that manner(by her texting you back)

Actually, if you contact the IRS they can reverse the money back out of her account if its hasn't already been spent. The state can likely do the same.
