What is the name of your state (only U.S. law)? Minnesota
Someone obtained our homeowners insurance information without our knowledge and used it to file a claim against us. He refuses to tell us or the insurance co how he got our info. We think that he must have gotten it illegally. What can we do to find out how he got it? Is it legal to file a claim against someone else's insurance company, I thought we had to initiate a claim? How would he get our insurance information without us giving it to him?

it is not privileged info that you have a right to secrecy concerning. There are many ways he could have gotten the info so it really does not matter.

I'd be giving thanks that I have insurance to defend me when claims are made against me. :rolleyes:

That is what insurance is FOR, after all, to protect you from claims. A better question is why did this person have to go behind your back to get the info instead of you providing it?

OP, you've been responded to by an informed consumer, an insurance adjuster, an insurance agent, and an underwriter/manager.

Now what part of our answers didn't you like?

Hint: If the claim is meritless, you have nothing to worry about. If the claim is valid, your insurance company should kiss his feet for timely filing of the claim. At least they won't have to defend you for your stall tactics. They wouldn't be happy about that. And neither would the department of insurance when they received the complaint.

when you say someone filed a claim "against" you, I assume you are referring to a liability claim. For this to be even considered by your insurance company for payment to a third party, they must get your approval, so someone else having your insurance information is irrelevant.

Your Insurance company will defend you and make a payment if you wish for them to. If not, tell them you don't want the claim filed, and deal with whatever the liability issue is on your own.
