Hello, I am Rino and I am new to this. I found myself here because I am trying to get out of a bad relationship before it is to late. In short- I have been advised to obtain an "ex-parte", although I do not know if I should, since I do not know what this is. I live in an apartment with my husband in Baltimore, and although it is in his name (actually, both our names) I pay all the bills, since he is unemployed. I would like for him to leave the apartment, since I am not from Baltimore, it has been hard for me to leave him since I do not have anywhere to go. He is also stealing my money and attempting to take away my car (in both our names, also) so I will not be able to leave him. Yesterday, he showed up at my work and tried to get me fired, until the cops came and removed him. THis is when I was advised to get an "ex-parte" What should I do? I do not have much money to pay a lawyer to tell me.

My response:

Well, in this case, you're almost correct. An ex-parte hearing is another way of saying "emergency" hearing.
So, what I'm going to suggest that you do is akin to an ex-parte hearing:

Since you've been threatened, and the police were involved, I would suggest that you go to your nearest criminal courts building and see the Filing Clerk at the window.

Ask the clerk for forms for a "Temporary Restraining Order".
Fill them out completely and GRAPHICALLY - - be very specific and use quotations where you can, and remember to be EXPLICIT and that you are in IMMEDIATE fear for your safety. Write down what you've said here, but be "urgent" with your words and tone. BE GRAPHIC with your words !! Let it ALL HANG OUT !! Don't be afraid to quote swear words, and other statements he made to you. Tell the judge all dates that these instances occurred.

Give the completed forms back to the clerk (you may need to pay a small filing fee), and the clerk will get you in to court immediately, where a judge will read your papers, and ask you a few questions, and then grant your orders for a TRO.

Then, once granted, you take the orders to the Marshall or Sheriff and have the Officer serve those orders on your husband.

That will get him escorted out of the apartment, and the orders will keep him from harassing you.
