I was recently stopped for something (not DUI or the likes) and the Asst. DA wants blood. I am conncerned that if she checks the records, another issue may come up. Someone used my identity in my home state of Wisconsin about 2 1/2 yrs ago. I was not even in the state when it happened and can prove it. I was not even aware of the ticket until after the judgement was passed. My parents received the notice in the mail at their home. My father went before the judge and explained the situation, but because he isn't an attorney, the judge could do nothing about it. I need to appear in person or hire someone which I can't afford. The judge told him that when I next visited I should bring the proof and resolve it myself, or just let it go and it will die in records in 3-5 yrs. This summer I realized I can't do that because I can't visit other family memebers whose states reciprocate with WI because I could be taken into custody.
Can I handle this by mail if I give written permission for my dad to act for me? Can I ask for another member of the DA's office to deal with my case if I can't get resolution with the asst. DA. This is a small town in MT and everyone knows everyone which helps and hinders this process.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Never have family rep you in court, especially if not a lawyer. Okay, basically, you CAN afford an attorney. You just aren't looking in the right places.

I am not sure where you are fighting this? Montana or Wisconsin. But all you have to do is contact the State Bar association of the state in which you are fighting this and ask them to refer you or help you find an attorney willing to put in some pro bono hours. Or ask for legal aid foundations in that state. Also, try getting a list of all the top law firms in the state in which you are fighting this. Then call each and ask if they room in the number of pro bono hours they have allocated. Big firms get big tax breaks and bonuses for taking on a percentage of pro bono cases a year. Ask them, beg them.

Last but not least, and ONLY resort to this if nothing else works, try these law schools:
