Son caught with xanax at school, what charges could he face?

What is the name of your state (only U.S. law)? VA
I told on my son to his principal that he had xanax on him and he was caught (my only way of getting him to stop). He was in trouble a couple months ago and was charged with disturbing the peace which went to a diversion specialist. This new charge now closes that case as unsuccessful. Im assuming he will be charged with possession with intent to distribute (he had 6 on him). So i was wondering what kind of sentence he could face for this. He has never been in any other trouble except for these 2 incidents.

he is 14, 9th grade. I dont know what he has been charged with yet. We havent received anything from the courts yet with his arraignment date.

You are both in trouble and need a lawyer.
This is a felony (if he were an adult), and hence being 14 he can be tried as one on a motion by the commonwealth's attorney.
This can have long ranging implications for him for the rest of his life.
Further, I would not complicate things by implicating him or yourself further without advice of counsel.

I suspect that he has simply not been caught except for these two incidents.

Where did he get the Xanax? Was it yours? That *might* be an issue. Or not.

As a juvenile probation officer, hats off to this parent. He is trying to get help for his son, and if getting the legal system involved is what it takes, he did the right thing. The juvenile probation dept and court can work, with the parent, on helping this kid.

The juvenile is (probably) also going to be expelled from school, although he may be given an opportunity to attend an alternative program.

I disagree .. he need not turn his own kid in to the government. Why do people think the government can help?

There are private companies that can assist your kid much better than any government can.

Your only way of getting him to stop from bring drugs to school? I doubt that. You could search him before he leaves the house (I would just hand him (naked) clothes, before he leaves , in a room I know there is no drugs in and have him get dressed and then drive him to school).

14 yr old kid outwitting dad huh? Not this dad.

I agree 100%, people almost never realize what will actually happen when the police get involved.

No, the criminal justice system has a GREAT record with drug addiction!

How could anyone ignore that!
