What is the name of your state? CA

Son is on probation for two years , unsupervised, for misdeameanor drinking in public , age 19.

Now he wants to go into the Air Force. The recruiter said he has to have his probation terminated. He has only been on probation for 6 months.

The court gave us some papers to modify his probation and some other papers for expungent of probation.

Can I fill these papers out myself and turn them into the court for a date with the judge or do I need a lawyer or legal aid to do this?

Also , is there a chance the judge will grant this? He has not been in any other trouble and he works most of the time.

Does he have to do anything else? Everyone we talk to has been so vague. We have spoken to probation dept. ( "not our problem")

Depends on how much legal experience you have.

Also , is there a chance the judge will grant this?
There is always a chance. And your chances can be increased by stapling a few hundred dollar bills to the paperwork!!

The court is under no obligation to terminate his probation. They may choose to do so, but it often takes a recommendation by the Probation Department (or at least some form of statement of no opposition).

He just might have to wait until his probation has gone for a year or more ... very often at least one year has to pass before such a motion will be considered.

Every Judge I know is granting an early termination of probation, for minor offenses, to those who are joining the military.

The only 'requirement' I know is the recruiter has to come to court with the defendant, or provide a letter stating the defendant is enlisting and, but for the probation, will be in the military ASAP.

I believe DDAs are not objecting.

Yes, you can fill out the paperwork & file, but he has to appear in court.

That's been my experience as well. It happens a lot up here.
