What is the name of your state (only U.S. law)? Virginia, my son punched another student in the nose, my son gave the student 3 warnings to get out of his face and then punched the student. My son was give a 3 day suspension. However, the parents are now threatening legal action, this incident happened in feb '09. The amount they are telling us to pay is 200.00, could you tell me what our rights in this case would be. Thanks for any help. My son is 13 and has never had any other incidents or problems in school and is AB honor roll student.

You have the right to punish your child for his violent behavior and to force his to pay for the out of pocket expenses for the battery he committed.

OP, you also have the right to follow your son around during school hours in rollors, a pink ratty bathrobe, make up that you have applied with your eyes closed, and a sign that says whose mother you are.

nope, i'm naturally crazy. :p

but i did find a ratty robe at the salvation army. in the next two weeks, i'm going to make my 11 year old create the sign. the deal is, if he is to walk to school on his own without supervision, he must attend school every day, on time. the one time he is late, i walk with him in the robe, with the sign every day for a week. if he skips, i walk with him during school hours. in full costume.

Your son assaulted another student. He could end up with a criminal record. He would also be responsible for any damages that the child suffered. Your son has issues. He may be an honor student but he is also violent and apparently needs to learn deal with his anger better. He is lucky that so far all he has had to deal with is a 3 day suspension. He could have been arrested.

The other two juvenile probation officers in my department and I have gone to school with some of our juvenile clients when they have had problems following school rules. We've never had to go more than once for any client.

I've threatened to do the rollers, ratty robe, and no makeup if I ever have to go for a second time.
