This is a tricky and a common legal issue. A family friend borrowed money from me in the amount of $500 and never paid it back. It has been 2 years now. It took us this long because we couldn't find her. She moved to several locations trying to evade me and others she borrowed from. I finally found her. A personal check in the amount of $500 was written to this family friend and has a note on it that says it is a loan. We have a proof of it from a copy of the check we got from the bank. My question is, can we sue this family friend in a small claim court to repay the amount she owe me? This family friend lied to us when she borrowed the money. She said she'll pay us as soon as she gets her 401K money.

You may not be able to sue her because this was a verbal agreement and the Statute of Limitations may have already run. I would be able to give you more information, but you apparently ignored the big red writing on every page of this forum which states:

"**** U.S. LAW ONLY - PLEASE INCLUDE YOUR STATE BECAUSE LAWS VARY FROM STATE TO STATE.****"

And laws regarding the Statute of Limitations do very from state to state especially concerning oral agreements. Have you always had such a difficult time following directions?
