What is the name of your state? vt. my son was attacked and beaten up pretty badly. The guy who did it was drunk and doesnt remember anything. The police have pictures...broken wrist, eye socket injury, bruises all over his body. The case is now closed. I just found this out today. I do not know the outcome, the courts will be calling me back through the victims advocacy program. The problem is since my son never filled out the paperwork with the victims advocacy program I don't know how to proceed with the medical bills. The bills are coming in my name since my son was staying with a friend and had no place at the time of the attack. I spoke with him today about the bills and how they were suppose to be paid. He said he didn't know, and that he heard nothing from the courts as to the outcome. I am going to guess that since the case is closed the courts allowed some kind of plea bargain. Is this guy still responsible for the bills? If he is then how do I go about getting the bills paid. The other problem is my son is leaving for a job out of state and won't be available to sue in a small claims court. Can I do this on his behalf?? What can i do? thanks Faith

Get all your evidence together (witnesses, police reports, etc.) and sue the attacker, assuming that you feel you have a case.

Your son needs to do this, unless he is a minor. You cannot do it for him just because it is inconvenient for him.

Bear in mind that you also could win a judgement and not collect a penny. Didn't some insurance cover his bills? Scumbags who go around getting drunk and beating people up often don't have two nickels to rub together, unfortunately.

had no insurance. The scumbag does work, so hopefully wage withholding can be an option on medical bills. faith
