Our seven year old son is a Special Education student (Speech and Learning). At the suggestion of the School District, we are in the process of participating in a Psychiatric Evaluation of our son. In October of this year he was suspended from school for five days. Subsequently, after we retained council, the suspension was promptly expunged by the School District.

We reviewed the documentation provided to the Psychiatrist by the School District and a cover letter authored by the school principal referenced our son's suspension and the specific reason for his suspension. The letter also does not note that the suspension was subsequently expunged. Legally, what course of action is available to us? Thanks in advance...

The evaluator needs all the evidence and facts to make their evaluation, not just what you would like them to review. Your child has problems, problems that are difficult to diagnose and understand. You may be used to your child's behaviors and thus not as aware of their appropriateness. An evaluation is needed to receive appropriate intervention and services. Intelligent children may have developmental disorders that require early intervention in order to identify their style of learning so they may learn how to better fit into society. The diagnosis may change as they mature.

Thank you rmet4nzkx. I agree with your comments and we did provide the suspension information to the Psychiatrist. My post is intended to examin the legal aspect of the principal's cover letter.
