Hi I have a legal question. My hubby and I are about to file for divorce. We are doing it together so there is not alot of arguing or disagreeing. He would like our 8 year old boy to reside with him and our 5 month old girl to reside with me. We have agreed on 50/50 visitation but he said he will still put in the divorce agreement that he will pay child support to me for our daughter. Once the divorce is final can he go back to court and have the child support dropped because we are sharing? or is it going to hold because of the agreement. He claims that he is very willing to pay for her but i am not sure how things will change down the road. Does anyone have any other suggestions? I am the one who wants the divorce...I do not want to take him for everything OR take his kids from him. And i do think that my son living with him would be ok since we will be living very close to one another...and we will not have a problem with sharing our time with the kids. But i still feel that after all the time i have spent raising them...i havent had a job and he makes 55 thou a year...i think that child support would be appropriate...also because he is keeping the house.
please help me ...i am confused. I am niave to the system and i dont want to get screwed over.
