in nj my dad lives in a house owned by his wife. they have a prenupt aggreement that allows him to live there for 2 years after her death. she is in a nursing home and we want to move dad out to a life care facility. her daughters are saying he is abandoning her and want to take us to court. i have power of attorny for dad and they have power of attorny for her. it does not say he has to stay in her house while she is in a nursing home and we believe she will never leave there. do they have any grounds for a court case? they also want dad to sign something that says he relinquishes all rights to the house. with the prenupt he does not own it he just lives there.
