Spousal immunity?

What is the name of your state? Maine

Does spousal immunity apply in a civil trial? I've filed suit against a husband and wife and was wondering if either can refuse to offer testimony which might show the other had in fact engaged in the activities I've alleged in my law suit.

My response:

The Spousal Privilege attaches in Criminal cases, only. This privilege has traditionally been limited to criminal cases. [United States v. Premises Known as 281 Syosset Woodbury Road, Woodbury, New York (2nd Cir. 1995) 71 F.3d 1067, 1070; see also SEC v. Lavin (DC Cir. 1997) 111 F.3d 921.
