Spousal Income

What is the name of your state (only U.S. law)? CA

I am in the process of having my child support recalculated. We went to court today, and my ex's attorney served me with new paperwork, and also told the Judge that I failed to include my wife's income on my Income and Expense Declaration.

Due to the new paperwork that was served, the hearing was continued.

I was under the impression that California does not take my wife's income into consideration when calculating child support. Is it necessary that I submit a new declaration with that added?

Also, by the time the new court date comes around, my ex will be remarried. (She is getting married next weekend) Would it be ok for me to tell her attorney that since she will also be married at the time of our next hearing, that she also needs to submit a new declaration that includes his income?

You need to fill out the form completely, and that includes your spouses income and whether or not they contribute to the household expenses...

If your ex fills out an I&E and her fiance does not live in the home at the time that she fills it out, then she need not include his information. Otherwise, she too must fill out the form completely.

I wasn't sure if she had to be married at the time she filled out the form, or by the next court date.
