What is the name of your state (only U.S. law)? kentucky

my husband of 9 years just up and left and filed for divorce. he is 65 i am 45. i have never worked outside the home, even in my previous marriage. we chose that i stay and raise the kids. i have no kids with this husband. he stopped paying all bills, removed my name from all financial accounts. i am living from help from my 82 year old parents. he is a professor and a lawyer and makes about 100,000 a year. will he at least have to pay so i can go back to school to learn a trade to support myslef and my youngest child who is 16. i am really scarred and he will not contact me at all. i am also disabled as i am deaf and all my medical coverage has also been cut off. what can i do? please help.

A nine year marriage is not long enough to be certain that you would be awarded any kind of alimony or spousal support.

You need to take advantage of any programs/aid that is available to get yourself into school ASAP. There are lots of programs out there for single mothers and programs for people with disabilities as well.

You also need an attorney ASAP to force him to reinstate your medical coverage and to prove pendente lite support until the divorce is finalized.

The husband is not the father of the child.

But, given what was stated here, there may be some recourse for spousal support. If so, a good attorney should be able to get some temporary orders in place pretty quickly.

Kentucky Alimony Laws

Spousal Maintenance (Alimony) Guidelines.
In Kentucky, alimony is referred to as "maintenance". The court may grant a maintenance order for either spouse only if it finds that the spouse seeking maintenance:

(a) Lacks sufficient property, including marital property apportioned to him, to provide for his reasonable needs; and

(b) Is unable to support himself through appropriate employment or is the custodian of a child whose condition or circumstances make it appropriate that the custodian not be required to seek employment outside the home.

The maintenance order shall be in such amounts and for such periods of time as the court deems just, and after considering all relevant factors including:

(a) The financial resources of the party seeking maintenance, including marital property apportioned to him, and his ability to meet his needs independently, including the extent to which a provision for support of a child living with the party includes a sum for that party as custodian;
(b) The time necessary to acquire sufficient education or training to enable the party seeking maintenance to find appropriate employment;
(c) The standard of living established during the marriage;
(d) The duration of the marriage;
(e) The age, and the physical and emotional condition of the spouse seeking maintenance; and
(f) The ability of the spouse from whom maintenance is sought to meet his needs while meeting those of the spouse seeking maintenance.

However, the court does allow the parties to enter into a separation agreement. In a proceeding for dissolution of marriage or for legal separation, the terms of the separation agreement, except those providing for the custody, support, and visitation of children, are binding upon the court unless it finds, after considering the economic circumstances of the parties and any other relevant evidence produced by the parties, on their own motion or on request of the court, that the separation agreement is unconscionable.

I didn't imply that he was....

OP's ex is NOT obligated to support her 16 year old...in other words, where is the 16 year old's father and is he supporting his child?

The man is 65 years old! He should be able to retire, at least partially. He worked to help you support another guys kid- pretty darn nice of him.

I was a Deaf Ed major, and the many very proud, working and contributing deaf adults I knew would be very upset to hear anyone claiming that being deaf makes one unable to earn a living. I knew many, many working professional and non professional deaf people.

The guy is 65, depending on himfor support is NOT a good plan. You certainly would have more stamina to hold down a job 10 years from now than he would. And If you don't get yourself into the workforce NOW, what will you do for support in a few years if he CAN'T work anymore, or if nobody will keep him as an employee?
