What is the name of your state? IL
Spouse incurred and went delinquent on credit card debt before marriage. Original debt was 2K - they want 8K. This all occured in TX - we have since moved to IL. House and cars are in my name only. Her name is on checking and savings account right now. She does have money in a Roth - about $600. She has no other major assets in her name - no income - stays home with kid. What can be taken? Are the assets in my name liable? My wages? Will IL 5 year SOL be the rule even though debt was incurred in TX? They of course are trying to work out a deal - do we have to do anything given her/my/our asset situation and the fact debt incurred before marriage?
Thank you,
D
