You should have asked for alimony during the divorce and before the divorce became final.

You either have found it's not so easy to make it on your own or you have been talking to some who were awarded alimony and now feel jealous and cheated.

You would have had to ask for it during the actual divorce proceedings. If you didn't, you are sol.

Since you were only married 5 years your odds of getting it would have been slim.

Spousal Support

I made it my selfe here in the states and I was not cheated on.

We have a court order that states that we would have endet up paying the same in childsuport as in spousel and it was troped not sure if I explaned it right so here is what it says.
After conference with the parties and their attorneys it is recommended no spousal support obligation be entered at this time. due to the gross complaint filed at such date ************** where plaintiff is the custodial parent who owes spousel support on this matter.The net between the calculations was entered on that case for child support.This dismissal is pending a request for a denovo or entitlement hearing by either party.
This matter will be set for closure procedure in no request is made whitin the appropriate time frame.

I guess when all this started I miss unterstood alot of things during the divorce time I am origanaly from germany and had alot of probleme communicating with any legal site.

What do you think ?

I think you need to get a consult with a local attorney....with the paperwork in hand.

If they are his legal children (rather than, say, your children that moved with you to the US) and you have legal custody, you CAN file for CS at any time up to the children's age of majority.

Unlikely.. Children have an ongoing need for support until they reach legal adulthood.

Adults are expected to support themselves, or to address the issue in the divorce.

Who has custody of the children? You haven't made that clear. It would seem at the time of your divorce what would be owed by the custodial parent in spousal support was offset by what was owed by the non-custodial parent in child support. Example - at the time, ex might have been ordered to pay you $500 spousal support, but you owed him $600 in child support, so you were only ordered to pay the net in child support, $100. If custody has changed or there has been a significant change in circumstances, a modification for recalculation of the child support may be needed. Keep in mind; however, that you would probably only have been awarded temporary spousal support due to the short term of the marriage whereas child support can be changed up to the child reaching the age of majority. That's the way I'm reading the short portion you've stated above. I have a feeling there is more said on this matter in the court order. Please clarify.

He has at this moment primary custady due to me working second shift we are how ever going back to mediation next month i am staying home mom now and I dont leave the house to go to work.
They have told me due to me working secind shift he can have the girl's when I work so he endet up with 4 over nights and I got 3 overnight's.
The girl's are with me now during the day and after school till he gets out of work.
I get them evey morning at 7:30 am and he gets them at 5:30 pm
It's all messed up hopfely it will change when we go back.
I am not even elought to take my girl's to germany.
He wont let the kid's out of the country.
My youngest has not seen her family in germany at all or neather has my parent's all they seen is pictures and over a webcam that I have for the PC.

None of the above has anything to do with spousal support. What would have been pertinent information from the beginning is you stating that you have remarried.

There is absolutely no reason he SHOULD allow the children out of the country. Since they now have dual passports, it would be very easy for you to abscond with the children and based on my experience with the German courts, he would most likely never see the children again.

If the only concern for you is that the children have not seen their german relations, tell those German relations they can fly here for a visit just as easily as the children can fly there.

As for child support, based on the liminted amount of facts in your post, it is doubtful you will qualify. Not only do you NOT have residental custody, but the amount of time the children are in your custody and your husband's custody is similiar. Also, you voluntarily quit your job so an income will be imputed to you if and when child support becomes an issue.

all in all, you have had a few idiots for attorneys.
