in 1999 my sister moved into our family home and started paying my father monthly installments on the mortgage for ownership of the home. He died in Oct. of last year and she has since been paying the mortgage directly to the mortgage company. Since there is no will of record can she legally have the mortgage put in her name to prevent my brother from taking the house away from her and my three younger siblings that now live with her in the house?

How did father hold title to the property at time of death? If it was joint, the other tenant(s) on the deed own the property. If not, the property is subject to Probate Court.

If my husband and I bought the mortgage on the house, or offered to pay my brother his share of the equity in the house, would my sisters still be able to live in the house without anyone taking it away from them? Is it legal to do something like that?
