What is the name of your state (only U.S. law)? TX
My ex filed for disability and has had an ALJ hearing. The SS Admin sent him a letter to call them and he called and they asked him several question about his financial situation. Does this mean he only qualifies for ssi and the kids will not recieve a monthly payment? Or is this just something that they always do?

He has worked in the past, but I do not know how much he made. The other question is how if he does get SSDI, do I make sure that the back pay goes to the kids and his attorney doesnt file for the kids and the backpay go to him? His attorney can not talk to me, as I have already called. We have had alot of issues regarding child support and I want to make sure I do not have to try to collect money from him that is for the kids, because I would never fully get it.

First , no one can say why SSA called him and asked questions .

Call SSA yourself and make sure they have your and the children's info. in case he is eligible for SSDI . That is depending on the Custodial order(s) .

I doubt his attorney would give SSA wrong informations , for him to collect any benefits that may be due the children .

I did call social security and they said that there is nothing available to the kids. They can give me no further information, until / unless there is something available to them they will set up an appointment. As far as the attorney, I did not mean that his attorney would file anything false, I just know he has the kids information and he does not have mine to sign the kids up, so the only way he could sign the kids up would be thru their dad. I just dont know what other options I might have.

At this point he hasn't even been approved , so there would be nothing for the children .

If the lawyer has the children's info. , I'm sure SSA has it .

There is no more you can do at this point .
