My LTD claim with Standard is 10 years old now.Every year I am required to requalify
for my benefits.My original policy was changed without my consent or warning.The ammendments added state that either I or Standard must pay for my annual physical,but I always have to pay.My policy requires ongoing medical care even though my care ceased 8 years ago by order of workmans comp
in California.I have had no care since a,d they continued to pay.Now they claim I must have continued care or lose my benefits.They also claim I have to have a physician sign a
form stating my inability to work in my usual occupation,even after telling me 6 years ago in writing,that I am disabled from all occupations I have the training to perform.After I took the form to a doctor he demanded to see my medical records,then said
the form the insurance company provided requires him to do a lumbar CT scan,MRI and every test necessary to prove I am disabled,but the insurance company says no,thats not what the form means and no physical is necessary.I have agreed to the tests if the insurance company assigns an agreed medical examiner and pays for the tests-they refuse . I cant afford the tests and the originals are 10 years old,and most of the records are missing.
I have gone to the VA Hospital for help,but cant get an appointment for 6 weeks.The insurance company has given me 6 weeks to have all the results in to them or they will cut off my benefits after 10 years !
They have promised me retraining,but now say its off because I have not completed the tests to requalify me for my claim.
They also required me to be interviewed in my home by both a Private Investigator and a Rhab person,and refuse to show me what they wrote about me.They also threatened to cutt off my benefits unless I gave them access to my bank records,credit history,and all public
non medical records about me.I signed the information request and I am doing my best with the VA, but the threats continue.
What defense if any do I have to prevent
benefit loss and future harrassment?
Is it legal to change my policy?
Can they say one thing and do the opposite?
