I have a pending bodily injury lawsuit for an auto accident from 1997. In MA does a judgment accrue interest from the date of injury or when the lawsuit is filed and at what rate?
My lawyer required reimbursement from me for all expenses. Initially they were going to be paid by my settlement. He found out my husband had received some monies and asked me to reimburse him. I did. Now he wants me to pay in advance for the expert testimony at trial of my treating physician. He said this will be thousands of dollars. I don't have the money but without the doctor's testimony, according to a judge reviewing the case, the jury's verdict would certainly be significantly lower. Any advice?
Prior to my retaining the attorney, the adjuster had offered me $5000. I did not accept it but having "earned it" on my own is my attorney entitled to that portion of my final settlement or judgment? I put a lot of work into this before the attorney took over. What is common legal practice?
