Standing in Handicapped Parking

I stopped my car in a Handicapped parking space to buy a newspaper. Car running, my wife, a licenced driver in the front seat. Officer ticketed immediately ($300). My wife offered to move the car, but officer asked her to remain so he could write the ticket. Appealed, but hearing officer said that you can't stand in a no handicapped parking space because handicapped people can't ask you to move. I asked to see where in the Massachussets General law it explained this and she told me I could probably find it on the internet.
If I broke the law I want to pay the fine, but I'd like to see the law and I'd like the sign to have said no standing if that's the law. Please advise.

wouldn't you call that "parking"? who cares if the engine is running and your wife is in the car. your car was stopped in a handicap parking space. case closed.

My response:

I love this guy's use of semantics. What the rest of us call "parking", this guy calls it "standing".

A horse of a different color is still a horse.

I call it standing. It's different than parking in that parking shows intent to leave the car there and the inability to move the car.

My response:

Really? I didn't know we were having the pleasure of talking to the Senate Judiciary Legislative Committee Chairman! I guess our writer's new definition of the law will take effect in January 2005. But, as of right now, that "meaning" or "intent" is NOT the law.

I believe that parking, standing, and/or stopping are all prohibited in a handicapped spot without the proper placard or plate.

There should be a statute number on the citation ... what is it?
