What is the name of your state? Fl
Any strategies on Harship license in in Florida- Third time life offense charge. No conviction ...no trial yet. Need license to get back and forth to work medical treatemnt etc.church,elderly parents , child etc. Any stargeies to present to DMV to increase chances ? Thanks

**A: yes, one strategy is learning to spell correctly. If you don't, that would be one hardship.

The DMV hearings here in Florida are pretty hard to win, according to the lawyer I had. The person who "hears" your case is not a judge, has no law degree. He's a public servant who sits and listens to cases like this every day, and generally follows whatever the arresting officer says. You can take a lawyer. The only thing I got out of my hearing was that we collected a bunch of discovery copies there that kept my lawyer from having to go out and seek it. The DMV hearing is unrelated to the court case.

My case seemed fairly strong, witness identified a different car, arresting officer's very first DUI arrest, just "sprung" from academy a few months prior, no erratic driving, no staggering, no slurred speech, no smell of booze, etc clearly stated on the arrest affadavit. What seemed like a sure thing to overturn the suspension ended up a slam-dunk in support of the suspension.
 
I know that in my state you dont have to go to the DMV hearing unless you think the suspension was for a wrong reason. However, In california if your underage you are able to obtain a hardship license through this questionaire/form that they have you fill out. It ask where you need to go, why you need to go there, what are you other options. I spoke with a guy at the DMV and he said just make sound like every other means of transportation is "inadequate." I havent sent mine in yet because i want to speak to the judge first to see if he can do anything. Im just afraid that when i send it in they will call me and start asking questions like "how are you getting to school and work right now? OBviously your getting there i guess you dont need your license."
