What is the name of your state (only U.S. law)? MA
Good evening all,
I wasn't sure if this should go be included as part of my original thread or if it would be best to submit it as a separate question to make it easier for others to find in the future.
I'd like to know what the rules are, in simple terms, for filing a counter motion. I read MRCP Rules 6 and 7 and I am a bit confused by the language:
Massachusetts Civil Procedure Rule 6
Massachusetts Civil Procedure Rule 7
I am preparing to attend a hearing for support modification filed by my ex. I'd like to file a counter motion (regarding the terms of support and related issues) now that I know I am permitted to do so. However, I only just discovered that I can do this, and the hearing is scheduled for Thursday. It seems, if I read the rules correctly, that motions can only be filed no later than 7 days before a hearing. Is that correct, or can I submit one to the Court during the hearing?
If I missed the window of opportunity to file one, what is the appropriate next step? Do I file a motion with the Court after the hearing (as opposed to a "counter motion")?
As always, thank you for taking the time to read my questions.
