What is the name of your state? Illinois

Does anyone know what the statue of limitations are in IL?
Also, although my debt is from CC's as a resident of IL, I now live in Canada. The debt is from 2001. How will they go about trying to collect?

The SOL in IL on a credit card is 5 years. However, since you've left the state and the US, the SOL has also likely been halted or 'tolled'.

They can go about trying to collect until hell freezes over. There are junk debt buyers out there who regularly buy 10,15, and 20 year old debts and attempt to collect !! Sadly, people who don't know their rights or the laws end up paying these slimeballs when they don't have to.

Thanks for your reply. So, if it is "tolled" it is frozen, yes? How long can this go on? In other words, if I move back to IL in 5 years, can they still sue me?

Yes, it would be 'frozen'. While its possible that this could come up, I've yet to read of it happening on any of the 4 boards I frequent. IF you were sued in the future, you would still use the SOL as your defense. The opposition may not know you've been out of the state, let alone out of the country. Theoretically it could go on for 'forever', but I doubt you'd have to deal with it.
