I live in NC. First let me apologize if this does not show in paragraph form I am posting from my cell phone and it does no always post the way I have written it.

At what point does a judge consider something status quo? My ex and I have 2 boys that we had 50/50 time with (without a court order) for approximately 4.5 years. Dad decided to change the arrangement due to schooling issues. I then had the boys 3 days a week and dad had 4 days a week. Due to my job loss I had to find a new career. I then had the boys 1/3 of the time. Dad received a change of venue and with it a temp order that stated everything had to remain status quo. The Temp order stated status quo was me only having Friday and Saturday nights. This has NEVER been status quo. I continued to have them on my 4 days off for the next 8 months. Dad filed contempt of court charges and told me we needed to stick with the CO. Since the beginning of September I have only had the boys 2 nights a week. If I can prove that dad acknowledges this has never been status quo then are my chances good that I will at least go back to having the boys for at least 1/3 of the time?

I am requesting full custody due to school issues and know I have an uphill battle because they go to school in dads county but at the very least I want to go back to having more time with them. I am just worried that the judge will now consider this status quo and I don't know how much longer I can do this schedule because I work 7 out of 9 weekends and am spending less time with the boys then I have in 13 years.
