Can the Statute of Limitations be extended if the State made an error? For instance, if there was a crime that
occurred and the State of Florida knew of the facts but wouldn't protect the interests of a minor, letting the
Statute of Limitations expire out?

Thanks,
Larry

No replies, okay. I'll be more specific

The question is about Statute of Limitations that had expired on a "LEWD AND LASCIVIOUS ACT" which was a Second degree felony, 3 years of Statute of Limitations, by Florida law.

However, the officer handling the complaint didn't question the offender about a fact in the statement form, that alcohol was involved and that there was no consent to have sex with the minor.

IF the State Attorney had listed this crime appropriately under 794.011(4): Sexual battery without consent. Under section D. When the offender, without the prior knowledge or consent of the victim, administers intoxicating substance.

This would've been a First degree felony, which has a 4 years Statute of Limitations, is this correct?

Please could someone answer my question.

Thanks,
Larry
