It all depends upon the type of action you intend to file. The Statute of Limitations has nothing to do with Small Claim court (albeit, any court).

For example, a Personal Injury action might very well have a different Statute of Limitations than a Contract action.

So, be very specific, and we'll be better able to assist you.
