What is the name of your state? Ohio

I posted in another area about an altercation between myself, my step-daughter, and my daughter. The incident took place on September 14th of this year. Long story short ... the two girls got into a verbal argument, which escalated into my step-daughter slamming my daughter against the side of the house several times, and me separating the two of them several times. During the course of the confrontation between the two girls, my step-daughter go in my face and cussed at me ... I lost my cool and slapped her across the face ~ opened handed. When my daughter finally made it in the house and alerted my husband to what was going on, he confronted his daughter about her actions, and she started cussing at him, screaming and would not be quiet and listen to what he was trying to say to her... she was terribly disrespectful to him, so he slapped her across the face ~ open handed. She is 16 years old, and at that point had lived with us for a little over 4 years. Step-daughter called her mother, who called the police ... bio-mom wanted the police to arrest me for slapping her child. A few weeks ago, we received court papers saying that both girls were being charged with assault against each other. A copy of the police report and statements were sent to CPS, who sent us a letter stating that they would not be investigating the allegation of abuse, as the incident didn't meet the criteria for abuse or neglect.

My question is ... is there a statute of limitations on a domestic violence charge? It has been 50 days since the incident occured, and hubby and I have talked with several people who have said that if it's been this long, chances are there aren't going to be DV charges filed against either of us for slapping his daughter ... others have said it is still very possible that we will both be charged with DV against his daughter.

Any input is appreciated.

statute of limitations?

I dont think slapping ur stepdaughter or your husband his daughter really falls under domestic violence as much as it does child abuse, If CPS sent a letter stating it would not be investigating the issue I would think that you are all set, Cps and the police usually work hand in hand in such matters so if CPS is not going to investigate then I highly dought the police will either.

Thanks for your reply. That's pretty much what I thought, too ... if CPS says there isn't enough there for a child abuse charge, why would the police get involved with a DV charge. But, you never know ... sometimes the system is hard to understand (why they do the things they do).

Thanks again.
