Virginia/ Is there a statute of limitations after filing a suit against an insurance company for bad faith in a fire loss. A suit was filed within 2 years of the loss at the courthouse. However, there has been no date for trial set. Is there a limit on a time for a hearing date?

Based on our experience, the statute is satisfied when the suit is filed on time. However, if the suit is dismissed for some reason you may not be able to refile a new one.

Typically, after a period of time the court or one side will send out notice or file a motion to have the case dismissed because of inactivity and each party will have a chance to respond.
