I have a friend that is currently trying to get a divorce but is scared because she is a stay at home mom. And her husband has told her he will keep their kids if she divorces him because he has a job and she don't. They live with her parents and she is a fit parent. Willing to work and they have a stable home in her parents house. But she is scared to force him to leave because of what he has told her. What should she do and are his threats valid?? They live in Houston TX. I know every judge and state is different. But what should her first step be in this situation?

She should handle her own business, like a grownup. "Willing to work" is not the same as "working," nor is it anything like "able to support self and children."

The fact that she does not have a job and is a stay at home mom is what will virtually guarantee that SHE gets primary custody of the children, NOT her husband. She is the primary caretaker of the children.

Her first step would be to get an attorney if at all possible.
