My ex has custody of my son and is married to a guy that smokes pot and I don't know what else he is involved in. pot is enough reason for me to want my son far away from this guy! My son asked me what does stoned mean because Eric(step-father) keeps saying "I'm so stoned". My son also wares Erics shirts when he comes to visit and frequently has burn holes on them. My son complains that Eric is controlling over him and his mom. His mom lets Eric do the discipline and make all the decisions for visitations with me. Do I have any rights to get my son away from this guy? Can I request a drug test And an evaluation on him?What is the name of your state (only U.S. law)? Indiana

Eric is not a party to the case so the court cannot order Eric to do anything. If he is ONLY into POT most courts do not make an issue of that -- at least not a major issue.

Now answer the questions asked of you regarding visitation and custody -- what does that order state? If you don't have an order WHY NOT?
