My stepsister died 2 years ago. Her ex-husband did not want custody of their daughter ("Lisa" 15 years old) so her maternal grandmother had custody of her. Now Grandmom is in cricical condition in the hospital and not expected to survive. Lisa's father still does not want her and Lisa's uncle (my step-brother) would like her to live with her grandfather and my mother (not blood related). Lisa would prefer foster care (my mother is strict and Lisa has essentially been on her own for the last 3 years). Who would make this decision? What legal pitfalls should my mother and step-father be aware of if they accept guardianship of her?
