I live in nc. My husband's daughter comes over 3 weekend s out of 4, she is eight.I have several ??
1) their court papers don't say anthing either way about who claimes her at tax time. He pays child support, and has joint custody. Can he chaim her?
2)Can MY income be used if the Ex tries to get more $$??

3) Can the stepfather's income be used to figure their income? They have a much higher standard of living than us.

4) My stepdaughter has to sllep on the pull-out couch when she is over here. Can that be used against us?

5) My husbands mom and sister talk his ex into letting the girl visit and stay overnight at the sister's house. The sister is gay with a live-in lover. My husband has tried to get his family to stop this, but they just go behind his back and talk the ex-wife into it. What can we do Legally?

Not unless it states he can on the court order, Ex has what is deemed physical custody, so she gets toclaim the child for Income Tax Purposes. She can by agreement and filing tax form 8332(I believe that is the correct number)give your husband permission to claim the child for the year.

No, spouses income does not have any bearing on child support. The mother and father alone are responsible for financially providing for the child(ren)

If it is only on the weekends for visits then no it shouldnt matter, now if you were trying to obtain custody then yes it would make a difference

That decision to allow sister to have visits and form a relationship with her aunt is not going to hurt anyone, most courts will not take the fact that the sister is gay into consideration. This question alone makes you look very prejudiced, and is not looked upon favorably in the courts eyes.

As long as any visits do not interfer with his court ordered visitation then there is nothing he can do as the mother has the right to make decisions to.

Also, if the 3/4 weekends are not court ordered then the mother can stop the extra any time she wants.
