hi..i think i read a similar question but i can't find it now..our visitation arrangement allows the kids to stay overnight on sunday to go to school on monday am ..then return after school to their mothers...on this particlar monday, there is no school, the kids have made arrangements to do things with their friends later on in the day...our agreement does not stipulate anything for this situation, however, due to a tenuous relationship and impending litigation, to cya...i advised the kids to make arrangements with their mother for transporation and permission, since technically, if they would have had school, they would be back at her house...she didn't want to drive them to their destination and told the children to tell me to "grow up". i just want to make sure i am correct, i believe their stepmom would agree verbally to let me transport the kids due to her not wanting to, but if pushed in court, would bring this up an an infringement..please clarify this for me...thanks sorry so long!!

I guess this is the part I am confused about. If you (the stepMom) wrote this, then what is this?

From what I got, the Mother does not want the children on that Monday during the day. Neither do you. Is this the case? If so, I'm not real sure what you would do. I would suppost if the court papers state that the Father take them to school in the am then that would be the ending of the visitation...making the ending being 8am (or whatever time school starts) Causing then the day off from school to be the Mother's time.

But, this also comes down to being an adult and working through it. If no one wants the children on this day, someone needs to step up and take responsbility for them. Whether it's you, the Father or the Mother.

i errored..i mean their mother didn't want to take them..and i think you missed the point...i wanted advise (legally) not your opinion...as to whether i am allowed to take the kids or pick the kids up from events, school, doctor, etc...when it is technically their mothers day...

If the Mother agrees for you or your husband to do such things on her time then yes, that's legal.
