still being sued after bankruptcy!

What is the name of your state? Florida.

I filed chapter 7 pro se before the deadline and have my 341 meeting on the 29th of the month.

I sent out letters to everyone on my matrix and received a copy of letter from what they sent out to everyone.

On 10/31 I received a court notice regarding a pending judgment from a creditor CA (and attorney in Florida) in my matrix

I promptly send out a letter to trustee, creditor and county courthouse saying this violated the automatic stay. Did I do the right thing?

I’m so nervous, I have not heard from anyone about what I should bring to the meeting. :eek:

A: Do you mean a pending LAWSUIT (i.e., there is no judgment yet) or do you mean a pending JUDGMENT (i.e., there is a judgment against you in a lawsuit)?

Yes. I meant pending lawsuit. They are trying to get a judgement against me and have been very agressive and they are what pushed me over the edge for bankruptcy. There is no judgements agaist me currently.

Yes, not paying your bills can lead to bankruptcy.

Anyway, carry all your documentation to the meeting and explain it the best you can.

Should I show up at the hearing and tell them again that I have filed for bankruptcy? I thought it was covered by an automatic stay.

I'd respond to the lawsuit with my bk filing number and ask the judge to stay the case until the bk is sorted out. Send a letter CRRR to both the creditor and the lawyer suing you. In fact, report the lawyer to the state bar association.
Show up at the trial as well just so there are no slipups.
 
update

I received in the mail yesterday my letter that I had CC'd the local county court in which the judge stamped it stayed. Not a word from the collection agency "lawyers." They were just trying to get a judgement before and had lied that they could not contact me. They have all of my contact info.

Anyway thanks to all who posted, I'm gearing up for my upcoming 341 meeting. I never want to be in this stiuation again. :rolleyes:
