What is the name of your state (only U.S. law)? Ohio

Wrote last night only on reply but will not give up. Please see the first thread. The question is have anyone used the court action under the ERISA Section 502(a) regarding a appeal, that was denied. Not sure if worth my time. As I lost now have to pay the company back 1400.00 just what I needed. Please help !!!

So instead of answering my question about why your claim was denied you post another thread asking the same question.

Is there some reason you won't say why your claim was denied?

Do you think that repeating the exact same question with no additional facts is going to get you better answers?

I need Help

The reason the employer denied as they state medical information regarding your absence was received. Upon careful review of the documention your application for disability leave has been denied. The last letter I got from them Sept 28,2009 and kept the case worker in touch verbaly called twice to three time a week . That I was looking for speicalist to review me. Was able to get appointment 10/20/09. Told worker would be able to send infornation to them after the the evaluation from Doctor. Before they got this medical information they had denied my claim. Was sent a letter could appeal this, therefore I did. This was also denied as first denial ruled. Found out all the information sent to dept was not reviewed after 10/08/09. Saw doctor 10/20/09 sent in this to case worker on 11/18/09. There is more but one of my questions is has anyone taken action using the ERISA Section 502(a) to help with employers that will not even look at doctors documentation after they request it, like they care and will assist you . Please help how this answers the question

No. I have never taken action using the ERISA Section 502(a) to help with employers that will not even look at doctors documentation after they request it.

Oh my gosh this is like pulling teeth. What is the reason you were denied? Did you provide insufficient documentation from a doctor? Did they say you had to see a specialist by a certain date and you didn't? Was your condition not one that qualified you for disability?

This is a very simple question and you have yet to answer it.

If you were denied for a valid reason you can appeal all you want but your chances of winning are slim to none.
