Hello Again, I posted a question a couple of weeks ago and it was helpful. Now I have new question and thought you might be able to point me in the right direction. I have been reading some of the other posts and find the information interesting. My question is, What forms would I need to go about filing a motion to make my sons father pay attorney's fees. I was looking in California Law Statutes and found Family Code 3120-3121 that interputs (if I am understanding the legal garble that the court will ensure that each party has access to legal representation to preserve each party's rights by ordering, if necessary based on the income and needs assessments, one party to pay the other party, or the other party's attorney. If I am correct and this is all to keep from paying child support then maybe he will let the whole thing drop. I cannot keep driving up there to court and his misc. appointments if he does not let me get back to work. I told his attorney, when he called to give me the date of the Judicial Custody Confrence that I have to go to work and this has to end. If I had gotten a job in lets say Sept. or so I would have been unemployed by the end of Nov. because I had to go up there five days. If I were a new employer I would fire me too. Not only that but the registration on my car expires in Feb. and I have no means to renew it so I will have no transportation. Any advice would be greatly appreciated. Thanks

If you are going to court for modification or establishment of child support or custody/visitation, the forms for these and the "response" form have a space to request attorney fees.

I can tell you that you can try, but if this is what the judge is going to hear it doesn't look to favorable for you to get those fees paid for.
