Employee Address: Hernando County

Place where the check was cashed: Publix in Hernando County

Feb 22, 02 Friday.
Got paid by bussiness check for work i did during the previous week's work. Went to Publix and cashed the check, Publix only cashes payroll containing the bussiness name.

Feb 25, 02 Monday.

Shoulder hurt to much to work with, so I called in sick, boss said no problem.

Feb 26, 02 Tuesday.

Boss called Me and asked if i was coming in to work, I said no, my shoulder was still too sore. He said 'Thats just fine, I don't need a Pu**y like you working for me anyways!' and hung up on me.

Went job hunting.

Got another job easier work, better pay, bene's etc. lucky me

Feb 27, 02 Wednesday.

Started new job

Mar 08, 02 Friday.

Got first paycheck from new company, went across street to Publix to cash. Cashier denied services and I was told i owed $208 to Publix for non-payment of the previous check from the previous employer. I was directed to the original Publix location to verify this. The Office Manager showed me the cashed check and there was a notice on it that the check had been stopped after I had cashed it, so the Publix Manager now claims that I owe Publix $208 for a bad check and I was responsible for it since I assumed responsibility for the funds when I signed the check since it was me who cashed it and my Driver's Liscence that was used for verification of Identity. She also said that Certified Mail about this had been sent to my address and the address of the bussiness.
Personally I have no idea why the previous employer would put a stop payment on a paycheck he knew he owed and I have never heard that I would be responsible for a payroll check, personal checks I can understand, but payroll? How is an employee supposed to be accountable for what an employer does with company funds ?

My question is what am I to do now? Am I responsible to Publix for him stopping the check before they deposit it? and just how do I go about fixing it, because dialog with the previous employer is impossible, he's already gone to jail for assaulting a Police Officer....

Go to the Hernando County Sheriff's office and see what their procedure is for prosecuting a bad check case.

Also, if you have the money, go to your local samll claims court and file a lawsuit against the employer for the money owed. Be sure to include the amount owed to Publix for any fees they charged you.

Also, keep in contact with Publix and set up payment arrangements.
