Hello. Been a while but here it is. I had my hearing and was found guilty. The Magistrate who usually is there was on sick leave and another Magistrate filled in. The Magistrate who filled in is known for finding people guilty because years ago before he became a Magistrate, he was Chief of Police for a small Township for 20 years near the city I'm from. The PO went first and presented their side. The PO had a copy of the certificate of accuracy for the speed device that was used. The PO did not have a certificate stating the speed timing device that was used was approved by the Bureau. The PO did not have a certificate or anything from the PA Bulletin stating the station was approved to calibrate the speed timing device that was used. I stated my side of it and I asked, If the PO had the original certificate issued for the accuracy and I stated that had a copy of PA vs. Cummings, and the PO said No. I asked if the PO had a certificate of approval for the speed timing device which I had a copy of and the PO stated No. I asked the PO if they had anything from the state or from the PA Bulletin which I had both copies of for the station as far as approval to certify and calibrate the speed timing device which was used and the PO stated No. Every time I asked a question, The PO would get more and more frustrated. The best part was the Magistrate had to stop the proceedings 3 times to tell the PO to calm down and that we were there for a summary trial and not to argue. It took everything in me not to laugh. I had obtained 2 pictures of the device that the PO used that included the front of the device and the make of the device and the serial number on the back of it. I asked the PO if the was the device used and the PO stated that they didn't know. I asked the PO about the distance on the citation that was .38 miles and asked if that was correct and the PO stated that it was. I said that in order for the PO to get a distance like that is the PO would have to look over a field, thru a house, a set of pine trees and an old stand where these 2 old people used to sell fruits and vegetables years ago. The PO got frustrated for the final time and then the Magistrate let loose. The whole proceeding was basically a joke and in the end, I was found guilty. I had 30 days to file an appeal at the Courthouse. I spent the $48.50 and filed on the 28th day. I had copies and pictures and everything else you could imagine pertaining to this case. My hearing was over a month away. My trial finally came about. I'm sitting in the Court room and in a matter of 15 minutes, the gentleman for the DA asked me 3 times what my name was and what was my appeal pertaining to. Finally it was my turn and the DA stated that they were not going to proceed any further as the PO didn't show up. I made a motion to dismiss the charge. All in all it was thrown out. It should have been thrown out at my hearing in front of the Magistrate. That's all.
