I am a resident in northwestern New Jersey.
Is the township responsible for storm water that is eroding my property? There are 2 culverts I am having problems with and 2 locations the water is actually running off the road and into my property. The 1st culvert has an easement from the township road 25 ft.wide by 329 ft. long it is not on my property. The ditch from the culvert for the storm water has not been maintain for over 3.5 years that I know of and probably longer so it is clogged and silted over in numerous locations. When we have a thunderstorm or heavy rains this ditch cannot handle the amount of water that flows in it and the water flows out and into my flag of my property then into my driveway.I have at my expense had to repair the driveway because of water erosion 9 monthes after the home was completed.We had a small ditch maybe 1 foot by 1 foot in size which now 3-4 ft wide by 2ft deep was made to handle the flow of a small running spring.

The second culvert was adjusted while we were owners of our property we were never notified nor am I aware that there was a township meeting. The water is now running into an old stone property line unable to flow so we now have wetlands to deal with and mosquitoes.

We are the 1st owners of the home and all specifications were met and we were approved for building permit, CO, Driveway design, Septic,etc..

Can A township do this?

Hire a civil engineer to check out the conditions and advise you accordingly. You may have to sue the town.
