street top coat responsibility?

What is the name of your state? GA

our developer finished the last house in the neighborhood recently. our private street top coat was awaiting the last house so that construction vehicles would no longer be on it. the developer now says he is done and the financial responsibility will be on the subdivision assoc. for the top coat. the street looks horrible with potholes everywhere. who is responsible for this? thanks

Q: who is responsible for this?

A: Read the covenants and restrictions.

If y'all have nothing in writing, y'all have two choices:

settle it among yourselves

OR

let a court settle it for y'all.

i appreciate your reply. as a side question, was the "ya'll" your manner of speaking or meant to poke fun at southern ignorance?
 
What I've seen in metro Atl is that the county will inspect the area - street, storm drains, detention ponds etc. Developer gets a punch list and then county takes over
I don't know if that was because of prior written agreements....
