My husband and I own some property. In one of our units the tenants have been there five years. Recently, new tenants moved in below them and have complained that the upstairs neighbors keep their trash outside under one of their windows. It states in the lease that the upstairs tenants can NOT keep anything out side of their unit. I wrote them a letter asking them to remove it and they didn't. I again sent another letter informing the WHOLE building that nothing should be stored/placed outside without our consent and that they should remove everything immediately and if they didn't we would assume they didn't want it and we would dispose of it. My question is this, do I have a right to throw out their things (trash cans, recycling bins, bags of soil)?
