I have a few questions:

Does anyone know anything about the teacher policy regarding not allowing students to bring home test papers after they've been graded? From what I understand, this is not an actual law, just an individual policy. I am wondering if a teacher can be forced to allow the papers or copies of the papers to leave the school if the student/parent has good reason.

Also, does anyone know if discrimination includes a teacher blatantly treating a student differently and unfairly than others (eg. stricter grading and eventually failing the student) even if there is no discernible reason such as race, sex, religion etc...?

And finally, if a parent wishes to take legal action against a public school, what kind of lawyer do you hire? If you can't find one who handles education law do you know what kind would be appropriate?

Thank you so much!

Why don't you just make an appointment to see the test papers if the teacher won't send them home?

Have you taken your concerns to the principal? Superintendent?

That's pretty drastic. Have you exhausted all possible solutions to this problem?

I have not attempted to view the papers at the school because it is an advanced algebra class and I am not qualified to evaluate that subject. Another teacher confided that the teacher in question was taking an excessive amount of points off for minor errors, even if the final outcome was correct. My son has proven his abilities in the new class, same subject, that he is in this semester. He currently has a 92% average. The former teacher failed him the previous semester with a 68%. In this school, if you fail the first semester of a class, then they fail you for the year, even if you do well 2nd semester, and you have to go to summer school.

I have spoken with the principal and he has lied to me and been downright deceitful in his promises of resolving the situation. I brought it to the superintendent's office and have dealt with the principal's supervisor. He refers the matter back to the principal, but the principal continues to do the opposite of what he claims. I'm tired of dealing with them. I have been reasonable, agreeable and accomodating. They have been unprofessional, un ethical and childish. They're pissed that I challenged them and now they're determined to see that they get they're way.

If your son has already received a grade for the course, then the papers may be gone. Did the other teacher tell you that the tests still exist? Did the other teacher also confide in you the reason for the unfair grading, or how he/she knows that the teacher was singling your child out?
