Can a student refuse to answer a question in a public high school?
I wouldnt answer a question a teacher ask me. Every time he ask I said no comment but I got in school sepention(sp?). I dont know but it dosent seem right to me.

He was asking me if something happened to me in the hallway. There where a group of people that dont like be and they tryed to start a fight with me and when the teacher ask me what happend i didnt feel like puting up with them and the questions so I said no comment and got ISS.

You've got to be kidding me. You have the priviledge of getting to go to school and you have the gull to disrespect an adult in your building that was taking the time to get both sides of the story. Instead of giving him an honest answer you copped and attitude. You should be ashamed of yourself!

Aside from the stupidity luvbskts showed, the correct answer to your question is no, you are under no legal obligation to answer the question put to you by the teacher. In fact, you are under no legal obligation to answer ANY question put to you, including those by a judge in a court setting.

What you have to understand however, is that some questions, regardless of whether or not you WISH to answer, carry with them civil and criminal penalties for not answering, as you are finding out.

The teacher's actions in light of you not answering are not illegal.

Stupidity?!?! Guess what my profession is? You got it, education. I am out here doing my best to make sure that I turn out educated, respectable, students so someday they can be good citizens. Believe it or not, it does get old to have kids mouth off to you day after day and there's nothing that you can do about it. Would you accept this behavior of your teenager? If not, why do you expect educators to tolerate it?
He may not legally have to answer these questions, but what about good old respect for someone of authority?

I apologize for not correctly spelling 2 words...may the world not come to an end. I do not teach English. I'm lucky enough to teach Sp. Ed, elementary level. I also did not offer any legal advise, contrary to what you stated. I only gave my personal opinion about his behavior towards an adult. I don't accept disrespect from a kid towards anyone, not just teachers.

Unless you've been in an educators shoes, you don't have a clue as to what I'm talking about. When this kid gets old enough to vote and pay taxes, then come talk to me about his rights!

ps...I love my job and my kids, I wouldn't trade it for the world!
