Hi again all,

A little background, and a question. Long story short, the ex was convicted of one of the lesser sex abuse charges against him. Placement on the registry was at the judge's discretion. The judge was adamant about protecting the community, so the ex was registered.

In October, he filed a motion to reconsider the placement on the registry. I got a VINE (Victim's Information Network) notice today that the case was closed. When I looked online for details, it said "Modification held SubCuria."

My question is: why would the case be "closed" if it's being held for later decision?

I was so excited, thinking he'd been ruled against and all this would stop, for 5 years, anyway.

A google search gave me this answer:

Sub curia means that the court is holding the motion for sentence modification until such a time as the defendant or his attorney, if applicable, notifies it that they are ready to proceed on the hearing. This usually happens when, for example, the modification will only be granted if the defendant completes something like drug/alcohol treatment or anger management. The reason it must be held sub curia is because this motion is due within 90 days of sentencing, but the defendant wants to wait longer than that for the hearing to take place.
