Hi,

I am a landlord wishing to allow a tenant to sub-let a portion of my property. The property is located in Phoenix, Arizona.

I thought of some rules that I may want to introduce:

1. All tenants must be approved by the landlord.
2. Lessee is responsible for all actions of sub-lessee.
3. Lease agreement between landlord and lessee supercedes all sub-agreements made between lessee and sub-lessees.

I also would like to work out security deposit issues such as who should hold the deposit. Lessee can pocket security deposit and stick landlord with damages made by sub-lessee. I can resolve this by requiring more than the usual one month deposit from the tenant. Arizona allows one and a half months rent as maximum security deposit.

I would also like the lessee's agreement with the sub-lessee to stipulate that the landlord can terminate the sub-lease for good reason of course.

Does anyone know of any city/state laws governing sub-letting? I could not find any on Internet. Also, does any of the things I mentioned above seem unreasonable or unlawful?

I would appreciate any incite the Law Forum can provide to help me do this correctly.

what you are trying to do does sound REASONABLE. if i were you i would A) get an attorney ( its definatly worth the money ) even if its only to draw up the agreement or B) call your local court house and find out what is acceptable and not acceptable.
