I've lived in the same apartment for 8 years and have a few issues to resolve. I am taking a job in another city and must vacate my apartment Feb 1, 2001. In 1997 I had an agreement with my landlord (added to the 1997-1998 contract) that I could sub-lease my apartment, as long as she approved the new tenant, and at no charge to me. When I asked my landlord two weeks ago about subleasing she said I could sublease and she hand-delivered a subleasing contract that stated I would pay a $75 cleaning fee, any fees necessary to advertise for a sublease, and a $250.00 processing fee. Of course I didn't sign the document. I informed her I would locate a person to take over my lease. She said she would still have to charge the $250 because she must approve of the new person first (background/credit check, and time spent doing this). I did not agree to that deal either. In the mean time I had advertised the apartmentand for sub-let and received several calls immediately. I have found a tenant (an assistant professor at a University) who wants to move in but my landlord said she must approve of this person. I finally just told my landlord that I'm going to let this person move in, and that I would collect a cashiers check or money order from the new tenant and in return pay the her (the landlord). She agreed to this arrangement but still wants to meet with the tenant. My question is; can I purchase a legal document for an agreement between me, the new tenant, and my landlord, and will this agreement hold up in court should the new tenant suddenly move out? Also, may I also apply my deposit toward the last months rent...I don't trust my landlord to return all my money.
